1. Scope and parties

These general terms and conditions ("Conditions") apply to all orders placed through the online shop nacar.co.uk of Urban Ponics B.V., Raadhuisstraat 8C, 5241 BL Rosmalen, the Netherlands (KvK 64289400, VAT number NL855601425B01) are posted. The customer ("you") is any natural person acting for purposes other than his profession or business. By placing an order, you agree to these Terms and Conditions.

2. Offer and formation of the agreement

The product presentation in the online shop is an invitation to order. By completing the ordering process, you make a binding offer to purchase the selected items. The contract is only concluded when we confirm the order by e-mail. We reserve the right to refuse orders. The contract language is Dutch; in case of disputes, the Dutch version shall prevail.

3. Prices and payment

All prices are in euro and include Dutch VAT. Shipping costs are calculated and displayed during the ordering process. We accept the payment methods shown during ordering (such as credit card, Klarna installment payments, Apple Pay, Google Pay and bank transfer). Payment is due immediately. Ownership of delivered goods is transferred only after full payment.

4. Delivery and shipment

We deliver to addresses within the European Union and selected other countries. Orders are usually dispatched within 1-3 working days after payment. The delivery time depends on the destination and the chosen shipping method. If we cannot meet a delivery date, we will contact you to offer a new date or free cancellation.

5. Right of withdrawal (cooling off period)

As a consumer, you have the right within 14 days revoke the distance contract without giving reasons when you buy goods online. For products, the period starts on the day you receive the goods; if the period ends on a non-working day, it is extended to the next working day. To exercise the right of withdrawal, you must notify us by e-mail or post. We will refund all payments received by you, including delivery costs (except for any additional costs because you have chosen a more expensive delivery method) without delay and at the latest within 14 days. We may wait to refund until we have received the goods back. You must return the goods without delay and in any case within 14 days of the withdrawal notice. You shall bear the direct costs of returning the goods.

Exceptions: The right of withdrawal applies not for sealed goods which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery. As NACAR capsules are dietary supplements and are delivered sealed, the right of withdrawal lapses as soon as the seal is broken.

6. Returns and refunds

Please contact us before returning any products. Returned items must be unused, in their original packaging and with proof of purchase. Upon receipt and inspection of the return, we will refund the purchase price via the payment method used.

7. Warranty

The statutory warranty applies. We guarantee that the products are free of material defects upon delivery. In case of defects, you are entitled to replacement or repair. If repair fails, you can claim a price reduction or dissolution of the contract. Legal rights remain unaffected.

8. Liability

Urban Ponics B.V. shall have unlimited liability for damage caused by intent or gross negligence and for damage due to injury to life, body or health. In case of slight negligence, we are only liable for the violation of essential contractual obligations; in this case, liability is limited to foreseeable, typical damages. We are not liable for damage due to improper use of the products or for medical claims without consulting a doctor. We are not responsible for the content of external links.

9. Customer service and complaints

For questions, complaints or warranty notifications, please contact us using the details in the colophon. We aim to respond within two working days.

10. Dispute resolution

The European Commission's online dispute resolution platform has been closed since 20 July 2025. A list of national dispute resolution bodies can be found on the Commission's website. Urban Ponics B.V. is neither obliged nor willing to participate in consumer arbitration.

11. Applicable law and competent court

These Conditions and all agreements are governed by Dutch law, with the exception of the Vienna Sales Convention. For consumers within the EU, mandatory provisions of the country of their habitual residence continue to apply. If you are an entrepreneur, the competent court in the district of our registered office has exclusive jurisdiction.

12. Final provisions

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Urban Ponics B.V. may amend these Terms at any time; the version in force at the time of your order shall apply.
